1. Agreement and provider
Octoryn Router is provided by Octopus Core Pty Ltd (ACN 696 931 236, ABN 28 696 931 236). By creating or using an authorised account, accepting an order, or accessing the service on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.
The service is primarily offered to businesses, managed customers and Octoryn family products. Mandatory rights that cannot lawfully be excluded remain unaffected.
2. Accounts, workspaces and credentials
You are responsible for authorised users, workspace configuration and activity performed with your credentials. Protect API keys and tokens, use separate credentials for separate environments, and notify us promptly of suspected compromise.
You must not share credentials outside the approved scope, embed server credentials in public clients, or bypass access, budget, quota or routing controls.
3. Service scope
Octoryn provides an OpenAI-compatible routing layer to eligible model providers and related operational controls. Available models, providers, regions, features and limits depend on workspace configuration, policy, provider availability and the applicable order.
A compatible API shape does not guarantee that every upstream model supports the same tools, modalities, context limits or output behaviour.
4. Customer applications and data
You retain rights in your applications and customer data. You grant us the limited rights necessary to process data on your instructions and provide, secure and support the service.
You are responsible for having lawful authority to submit content, configuring appropriate routes, informing affected people where required, and applying human review to high-impact uses.
5. Acceptable use
You must comply with the Acceptable Use Policy, applicable law and the terms of eligible model providers. You must not use the service to cause harm, violate rights, evade safeguards, conduct unauthorised security testing, or build prohibited or deceptive systems.
We may investigate suspected abuse and may restrict or suspend affected access where reasonably necessary to protect people, customers, providers or the service.
6. Provider services and output
Model providers are independent third parties. Provider supply, model behaviour and terms may change. Octoryn applies the configured routing boundary but does not control every upstream service.
Model output may be inaccurate, incomplete or unsuitable. You are responsible for evaluating output and must not rely on it as the sole basis for legal, medical, financial, employment or other consequential decisions.
7. Fees and taxes
Fees, usage treatment, payment terms and taxes are specified in the applicable order or customer agreement. This website does not create a public subscription, PEU package or payment entitlement.
You must pay undisputed amounts when due. Any provider charges paid through customer-owned accounts remain the customer’s responsibility unless the order states otherwise.
8. Intellectual property and feedback
We and our licensors retain rights in the Router, documentation, branding and service technology. No rights are granted except the limited right to use the service within the authorised scope.
If you provide feedback, you permit us to use it without obligation, provided we do not identify you or disclose confidential information without permission.
9. Confidentiality and security
Each party must protect the other party’s confidential information using reasonable care and use it only for the agreed relationship. Standard exceptions apply to information already known, public without breach, independently developed or lawfully received.
Security responsibilities are shared: we protect the Router within the agreed boundary; you protect applications, users, credentials, customer configuration and downstream actions.
10. Availability, changes and suspension
Service levels, support hours and maintenance commitments are those in the applicable agreement. No public SLA is created by this page.
We may change the service to improve security, compatibility or operations. We may suspend access for material breach, security risk, unlawful use, non-payment or provider restrictions, using notice where reasonably practicable.
11. Warranties and liability
To the extent permitted by law, the service is provided without implied warranties beyond those expressly stated in the applicable agreement. We do not warrant uninterrupted provider supply or error-free model output.
Liability exclusions, caps and indemnities are governed by the applicable negotiated agreement. Nothing in these Terms excludes rights or liability that cannot lawfully be excluded, including applicable Australian Consumer Law guarantees.
12. Termination, governing law and contact
Either party may terminate as permitted by the applicable agreement. On termination, access ends and data is returned or deleted under the agreement and DPA, subject to lawful retention.
These Terms are governed by the laws of New South Wales, Australia, unless the applicable agreement states otherwise. Legal notices may be sent to legal@octopusos.ai.
